Justice Onnoghen’s Suspension; A Highest Form OF Executive Rascality – By Itsede Okhai, Esq

Let me try to break this down in the language we will all understand…

The News came yesterday that the notorious President suspended Justice Onnoghen as CJN purportedly on the “secret” order given by Code of Conduct Tribunal and immediately sworn in Justice Tanko Muhammed as Acting CJN

First, it’s the highest form of judicial calamity for a Court to secretly, and without notice to all parties, consider or make any order in any issue for which parties are already before it. Ex parte order(an order given by Court without listening to all parties involved) CANNOT lie when parties are already before the Court. When parties are already in Court, the judicial rule is that any party to be affected must be given the opportunity to be in Court and argue the issue(s).

The Court of Appeal two days ago gave an order, barring the Tribunal from continuing the CJN’s case or doing any act in respect of the issues before it. Part of the case before the Tribunal was an application from the government’s Prosecutors, asking the Tribunal to order the CJN to vacate the office to face his trial. But the Tribunal despised the Court of Appeal’s Order and secretly ordered the CJN to “step aside”.

While giving the purported Order, the CCT Chairman, Justice Danladi relied on the criminal charges against the CJN as the basis for the order.

The Chairman of CCT from which the “panel-beated” Order the devious President relied on has a criminal case against him at the Federal High Court on issues bothering on corruption. But he has not stepped down. He sat to give such a shameless order, mandating his boss to step aside for similar issues for which this government is honouring him.

The President’s assistant on Public Prosecution, Mr. Okoi Obono-obla, was indicted by members of House of Representatives for certificate forgery. WAEC publicly confirmed that the certificate was truly forged. He has not “stepped aside” neither is there any criminal charge against him in Court. But he advised and publicly defended the President for such bravery against the CJN.

–President Buhari, the gap-toothed emperoric Hitler who mischievously read the long suspension note, apparently written for him, has his asset declaration shrouded in secrecy. No one can authoritatively say what Buhari declared. All applications from individuals to confirm and access the assets declared by Buhari were declined by CCB, hiding under some quotes unknown to law.

The President CANNOT, under our laws unilaterally suspend or remove the CJN for WHATEVER reason. He can’t even hide under the Order of any Court. The 3 arms of government must play vital roles in his appointment, removal (including this technical removal). The President, the Senate President and the CJN are equal partners. Just like the office of the President, the office of the CJN is created by the Constitution with security of tenure. None can remove the other unilaterally as there are strict procedures laid out in our Constitution. See Sections 6; 230(1)(a); 231 (1) (2); Section 292 (1) and Paragraph 20 and 21 of the Third Schedule to the Constitution of the Constitution of the Federal Republic of Nigeria, 1999

Now, ladies and gentlemen, the New CJN, Justice Tanko Mohammed from Bauchi State, was sworn in yesterday, and today he is going to set up Election Tribunal that will determine all issues that may arise from the next election.

Oh, did I remind you that Buhari’s niece, Amina Zakari, after all said and done, is still in charge of the final collation of presidential election results?

In all these arrangements, this is the final result:
*The President- Northern Muslim
*Chief Justice of Nigeria- Northern Muslim
*Chief of Army Staff: Northern Muslim
*Inspector General of Police: Northern Muslim
*Presidential Election’s Collation Head: Northern Muslim

These are the people that will decide the winner of the next election in Nigeria.

Oh, I forgot that tribes and religion don’t matter only under Buhari, especially when it tilts towards a specific people. It’s one Nigeria of the 97/5 percenters.

The President is not here to play. It’s easy to give a monkey banana but to get it back is war.

Those calling on NASS to remove Buhari should forget it. It’s too late. The CJN has a role to play in removing the President and you already know the situation on ground. PMB has strategically build an impenetrable rampart around himself. But are we going to sit and watch this judical calamity and executive rascality have their way? Hell No!
